Correcting I-94

  • Correcting I-94

    Hi - though visa for me and my family has been extended, but CBP officer on our port of entry last week could give I-94 to me and my wife only upto their passport expiry date and not matching visa expiry date. He did explain me this.

    My question is once I get passport renewed for my wife and daughter (while in US) can i get the I-94 date corrected for them, without leaving US.

    Appreciate some clarification please.

    3 Options, after passport renewal.

    1. Go to nearest CBP office and request if they would renew the I-94 (before I-94 expiry).
    2. File extension usign form I539 (before I-94 expiry).
    3. Leave US and re enter.

      Note regarding this option -- extension of status for the L-1 can only be done by the employer filing I-129; it cannot be done by the person themselves. For the L-2s they can file I-539 together with or after the L-1's I-129 filing, or after the L-1 re-enters.
