Anyone aware 1-year time sensitive limitation for L1B?

  • Anyone aware 1-year time sensitive limitation for L1B?

    I guess my situation is a bit different(although I hope that's not the case): I was working for a global company at US, later on because I did not obtain the H1B visa, so my company ICT me to UK. I was told after one year I can transfer back to US using the L1B. Yet when the time comes, the lawyer suggests to wait for 1.5 year instead of 1 year because the rejection rate is high if applying right after working one year oversea at UK.

    Personally I trust the lawyer but I do want to go back to US as soon as possible so would like to get some expert suggestion/experience whether it's necessary to wait another 6 more months before submitting the L1 visa.

    Technically 1 Year is sufficient, but it would not be valid to assume that merely staying out for an year, and working for a qualifying organization qualifies one for L1B.
