  • J1 2 year rule - L2 EAD conflict resolution

    Hello,

    I visited US 10 years ago for a 2 month internship on a J1 visa. 2 year residency rule was applicable on my visa. I had an Indian passport then but never got a chance to spend continuous 2 years in India. I was naturalized to a british citizen about 2 years ago. I received my L2 EAD card about 6 months on my british passport. Now I have been trying to seek work opportunities in US. I want to know if I will still be subject to 2 year residency rule, despite the fact that I have my EAD and that I have changed my passport.

    HRR continues to apply to you regardless of your new nationality

    It does seem that they have mistakenly granted you your L visa

      The country you have to spend 2 years in is the country of your nationality or permanent residency if different from nationality at the time of getting J status. Were you a British permanent resident at the time you came to the US on J1? If so, it could be that the country you had to spend 2 years in was the UK and you satisfied it.
