  • I-94 beyond VISA Expiry, Options for urgent travel needs ( if needed)

    Hi All.

I am on L1A Blanket VISA.
    VISA is expiring on 30-Mar-2018.
    PED is 01-Mar-2018
    I-94 is 21-May-2019

I cannot apply for extension until Dec-2018 i.e 6 months before I-94 expiry

    i have few questions
    1. When my company applies for extension in Dec-2018, will the USCIS say that VISA was already expired and hence cannot be extended?
    2. What is the significance of PED date for a blanket
    3. I understand that if i travel after Mar-2018, my I-94 will be invalidated and i will have to re-enter with fresh VISA. Is there any cooling period?
    4. Should i take a short trip to mexico or canada in say Nov-17 and hope that at POE my I-94 will be retracted to Mar-18 and i ask my company to file extension? That way, i will be able be travel ready if i need to travel.

    Thanks a lot

    Same boat

I am in the same boat as you, see my post on this forum, I was given longer I-94 way beyond my PED
I called by CBP office and was told that it’s correct since I am on a blanket visa but I have heard many conflicting views on this
What I have found is that you cannot work in the US if you petition I129S is expired. Hence you need to extend it
My employer said they will extend even if I-94 is valid and they will write a support letter to USCIS to explain that I94 date is incorrect
I think you should ask your employer to do that same

        1. Visa is merely for entry purposes. Visa expiry has got nothing to do with your ability to stay or work in the US.
        3. Whenever you leave the US, the current I94 no longer carries any significance, and you will be issued a fresh I94 upon reentry. For reentry you will ofcourse need a valid Visa stamp in your passport.
        4. Your employer can file for extension and explain the problem with I94, as another poster commented above.
Just an opinion; Not legal advice.

I am also in same situation. My visa details is given below.

          L1B issue date : 11 May 2015
          L1B expiry date : 10 May 2018
          I129s valid till : 29 Apr 2018
          I94 valid till : 18 June 2020

I spoke to internal immigration team and they confirmed that I have to raise request before my I129s expires even my I94 is still valid till June 2020.
