  • L1A Visa - Reentry

    Hi,

I was on L1A for 5 year in US and my L1A extension rejected in Jun-17 and returned to India. My employer processed a new L1A individual petition and it got approved. I am not sure if I need to go for stamping or not.

I am seeking for your help in answering below questions and suggest

    1. If I travel soon after my stamping, Will I get only 2 years whichever left over from the previous visit ?
    2. I heard if I wait till Jun-18, I could be eligible for 7 years visa validity (with possible 2 extensions). If yes, Do I need to hold my stamping till Jun-18 ? OR Am I still eligible to to get 7 years visa (3+2+2) if I wait after stamping done (assuming it goes smooth) in the next few weeks.

    Appreciated your help

You need to stay outside US for one full year to be eligible for another term of 7 years. So if June 2018 is when you complete it, you will have to wait till then for that possibility. Visa validity only allows to enter the country, the I-94 determines your duration of stay.
