Can H1b application and L1 Individual extension in parallel

Hi All,


Situation - My husband is working on L1-B Individual visa and his visa expiry date is June 2018 - 1st week.

1) Can my husband apply for H1B and parallel apply for L1 extension this year in month of April and March respectively?
2) If my husband get's into H1 lottery and also petition gets approved in Oct and L1b extension also gets approved which visa will he be allowed to hold?
3) I am also planning to apply for H1b this year-April. Can I also be on L2 visa and apply for H1B?

You can apply & hold multiple non-immigrant visas at one time. so yes, you can do that.

2) If my husband get's into H1 lottery and also petition gets approved in Oct and L1b extension also gets approved which visa will he be allowed to hold?

For visa you'll need to leave the country & go to your home country for stamping. After that when you re-enter you'll be asked to choose which visa you want to use H1 or L1.

If you are not going out of country & not filing COS either, you'll continue to be on your current visa (which is L1B).

You can apply & hold multiple non-immigrant visas at one time. so yes, you can do that.
