  • L2 DropBox Now Administrative Processing

    hi,

My spouse had valid L2 visa until Mar 11, 2018 (and currently, is in India since mid-February 2018). I am currently in US (even though my visa expired on Mar 11, 2018, my employer filed for L1A extension and got it approved on Mar 10, 2018). My spouse applied for L2 visa extension In India in April, 2018 and was eligible for Interview Waiver. We submitted all documents via Dropbox, however, now the visa status updated on the website is 'Administrative Processing'.

Anyone in a similar situation as us? Appreciate any inputs.
    thanks!

      Same situation

My spouse did dropbox on 26th April and now status on 2nd May is administrative processing.

I am not sure why application went to Chennai. I gave them Mumbai.

        Hi Deepak,
My spouse got his passport back with a note to submit the principal applicant?s I-94 and Visa stamp. We re-submitted the passport with these documents today, though, both of them expired as of Mar 2018.

I am still in the US. My status is maintained due to an approved I-129 and L1A extension filed by my employer.

Not sure why they asked for I-94.

        Good luck for your Visa

I would suggest keep tracking the Visa case on CEAC Website. Also, check for passport status and pick up your passport as soon as it?s ready for pick up. If they need anything from you, they will return the passport along with the note for additional documents.

I wife's visa status got changed to issued. Passport is in transit. I am tracking it very closely because she has flight on Saturday evening.

Hopefully we get it by that time.

All the best for your L2 Visa. Btw did you submit your extension approval docs. Those are required. These docs also have extended I-94.

Congrats and good luck! You will be fine

            Thanks for your inputs.

We had already submitted I-797 approval notice with the drop-box submission. You are right, that does have the I-94 latest record too.

We emailed the support us docs team to re-submit the I-797 approval notice (that has appended I-94)
to the embassy along with our passports. Hoping it works out well.

We don?t have the email address of the embassy, else we could have written to them directly too.

Ohh may be support team did not provide the copy of I-797 approval. I think its better even submit 3 latest paystubs and current employment letters of you. This was advised by lawyer to me but varies case to case.

There is one catch here though. There is need of repaying(second time) of $500 fraud protection fee when stamping principle applicants visa, in case your I797 is newly used for extension and not the one used for 1st time L1 visa was issued. In your case you might not have paid (second time $500) this fee since your L1 is not stamped.

So just be prepared in case you also need to travel. I hope you don't need to.

thanks Deepak. I will keep these documents ready incase, they ask for these documents again.

I emailed a copy of my petition too (that has payslips, form 1-129 etc.) along with my I-94 to the support team.

                  hope things work out.

you mean, if I797 is used for spouse' L2 visa extension before mine, I have to pay a 500$ fee?

I did visa stamping for my previous extension (L1-A) without paying any fraud fee.

Not every L1 stamping needs fraud fee. If I797 used for blanket petition is new then only fraud fee is required. Its applicable for blanket petition and not sure about individual L1

What I am coming at is, usually they want principle applicant's visa stamped on passport before they do L2 stamping. In your case your stamp is expired so they may not approve it. I have seen on this forum one case rejected due to husband not having L1 stamp.

You consult a lawyer in this matter for proper advice otherwise your spouse application may get stuck. All the best.

Okay, sure thanks for letting me know. Do you have link to that thread so I can take a look.

I consulted my company?s consultant lawyers and according to them, L2 Visa can be stamped with my approved petition and I-94.

Also, the case got updated to today?s date but the status remains the same. Did your wife?s visa status also read ?the Visa case is undergoing necessary administrative processing...? before it changed to ?issued?.

Yes it was in administrative processing for 1 day before issued.

sorry could not find link now. If you took advice from lawyer then its ok.
