L1 Visa Expiring can we go ahead and get new visa applied from Cananda

  • L1 Visa Expiring can we go ahead and get new visa applied from Cananda

    Hi Friends, (Need urgent information and point of view)

    I have my L1 visa getting expired on 19th Mar 2019. My company is suggesting to get the new L1 visa from Canada but I am getting only 27th feb 2019 as the appointment date.

    Now my question is

    1. If my visa gets rejected would Port of entry will allow me to enter again in USA or will my entry be denied as only 2 weeks left on my current L1 visa and I have go back from cananda to my home country?
    2. Should I go for new L1 visa or visa extension/ renewal?
    few More information: my I94 is valid till 20th Aug 2020 and my husband is on EAD valid till Sep 2019 working in USA

    If your visa is approved, you are all good to enter USA again.
    If your visa is not approved, there will be 2 situations:
    1. Quite possible that they will cancel your existing visa too
    2. If they don't cancel, then yes, you can enter USA again on the valid visa

    Since you are already in USA, you just need a valid petition (don't worry about visa) to continue staying in USA.

    Visa you'll need only when you go out of USA & then try to re-enter - so if you are not planning to visit out of USA just an extension is fine.
