  • L-1A Visa extension denied (I-129L) but has valid EAD till Jan 2020

    Hi All

This is my first message to this forum, i have query regarding for visa extension

L-1A Visa: Applied for visa extension, which got denied, I dont have valid I-94

Green Card I have I-140 Approved and have valid EAD till Jan 2020, I-485 is in progress

    Questions

    1. Does it impact GC process?
    2. Do I need to leave the country?
    3. do I need to have valid visa for I-485 decision?

I appreciate your response and replies.

    Thanks

No, GC is an application for future employment - it will remain valid.

Yes, Since your L1 extension is denied & you don't have I94 you'll need to leave the country asap.

    Your I140 will remain valid.

Not exactly the visa - but you need to have an valid status to adjust it to permanent resident - which you do not have right now.

Consult an attorney, your 485 might be cancelled.

Understand that it is an application to "adjust status", since you do not have a valid status right now - it won't be adjusted.

You'll need to leave the country & get your GC from your home country & enter USA again with that.

    Hope this helps.
