    Green card

Yes, you may apply for Adjustment of Status. You need to file Form I-485 Application to Register Permanent Residence or Adjust Status, with the USCIS.

Advance Parole is permission for certain foreign nationals, who do not have a valid immigrant visa, to reenter the U.S. after traveling abroad.

If you do not apply for Advance Parole before leaving the U.S., the U.S. Citizenship and Immigration Services (USCIS) considers you to have abandoned your adjustment of status application, and may not permit you to return to the U.S.

As a foreign national in the U.S., you should, prior to departure, obtain Advance Parole if you have-

Filed an Adjustment of Status application but have not received a decision from the USCIS.

---- Yes, you can apply for a Green Card starting with Labor Certification. It takes a little longer as the employer is not (and will not be) a US based employer

also if i apply, do i need to be in US as long as my greencard process is pending?

---- Not necessarily, depending on the stages of the GC processing you may have to stay for a few days

what if i leave US(during greencard process) as my visa status is dependent on my husbands?

---- It is not a problem. You can return back to US if you have a valid and unexpired Visa stamped on your Passport

              L2 problem

              Hello,
I was browsing through this thread and would like to really thank u for all the good advice.
              My problem is:
I am currently on L2 with my EAD.
My L2 is expiring June 2009 and my EAD expiring May 2009.
              The issue is :
I am told that there is some renewal problem for my husband's L1-B and we may have to go back to India and get it renewed from there.
              I am currently working.
So if my L2 visa has to be renewed then my EAD also has to be renewed right?
              1. So can I apply to renew my EAD before my visa expires?

              2. Also, will I not be able to work after May as I do not have a valid EAD?

              3. Further, I am interested in applying for H1 next year.
The issue here is I have shown some more exp when I joined this firm.
If my current employer files my H1,will he come to know abt it?

              4. Also,if I apply H1 frm another consultant and then after I get H1 approved,if I transfer it to my current employer, will he still be able to find out my **** exp?

              Pls help.
Also,Can I go back to India and renew my L2 even before it expires?

Adjustment of Status that you have talked abt, shld it be filed by an employer or can I file it individually/
              Pls explain the procedure.

                1. EAD depends on L1 petition dates and L2 I-94. You need L2 extension for L2 EAD renewal. Visa as such has no significance once inside the US, I-94 rules.
                2. Yes, No EAD = No Work.
                3. Resume faking is wrong! They will as you have to submit a resume and might result in job termination.
                4. #3.

L2 renewal needs approved L1 renewal first.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
