    HI,

    I came to US in Aug-2006 on L1B from company A.
    After that Company B applied for COS to H1 in April-2007; H1 got approved in July-2007 and will be effective from Oct1st.
    In Aug-2007, Company A applied for my COS from L1B to L1A and that also got approved in Sept-2007 .

    Question -

    1. Whats my final status now? are both H1 and L1A active.... or just L1A is active as thats last approved from INS

    2. Company B which has done my H1 is not good and i need to file transfer of H1 to company C. Can i file transfer now itself and use my payslip of Aug/07, Sept/07 issued from company A for transfer to company C?

    Appreciate if Subramanya or any senior member can reply me soon.

    L1A is the one that was decided last and is the one active.

    If you decided to switch to H1 you will have to get H1 stamped or file for COS and wait for it to be approved.

    Since you are not on H1 right now you cannot tranfer it, but the new Company C can apply for H1 with premium processing using your prev issued H1 as proof of being cap exempt. But you will have to wait for approval to begin work for them.

      thanks for clarification. But i am not able to understand abt filling of H1 thru company C using this cap. Is it possible as H1 was issued to Comapny B? I am new to all this so never came across it.. appreciate if u can explain this point little more.

        you said you wanted to transfer to Company C. but you cannot do a usual transfer as you are not in H1 right now. Get Company C to apply premium H1 for you. You are not subject to cap as you have an H1 approved already though through a different company.
