  • RFE recieved on training..

We applied for extension(L1 B ) before I 94 expiry date (now both my visa and I-94 expired). Last week we recieved RFE. RFE says they needs details of training i had and my roles and responsibilities. i just sent the details to my employer.
    - Is it like if we recieve RFE, chances are high to get denied?
    - if we send those details and apply for premium processing( we filed through normal processing. now we are planning to use premium processing), will it help in any way?
    - at worst case if it get denied, will it create any prblem when i apply again for visa?
As I am new to these formalities, can any one help me out with your suggestions? thanks very much in advacne.

    1. No such thing as RFE results in denial. RFE is for additional clarification.
    2. No special advantage other than it gets you the result (approval/denial) sooner thereby reducing your unauthorized stay if it gets denied.
    3. You have to mention it on your DS 156 as a denial results in you accumulating unauthorized presence. 180 days or above of such period qualifies for a 3 year ban and 365 days for a 10 year ban.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
