L1 Blanket Extension-Urgent Please

I cam to USA in 2006 on a blanket L1 petition with L1 visa valid upto November 1, 2008. My Wife and son also has valid L2 till November 1, 2008. Out I-94's are also valid till this date.

My employer filed for extension on 30 October 2008. We already received I797C-receipt Number. As per current information it is taking 2-3 months for getting extension approval. My lawyer told me that I can stay and work in USA for 240 days from the date of application filling.

I have to travel to India for some personal reasons on December 20, 2008. My lawyer has prepared all the paperwork for me so that I can appear at USA consulate in Delhi to get new visa stamped. According to lawyer, as I am appying for extension under an approved Blanket L1 petition, visa stamping won't be an issue. Also, I can show I797 receipt to prove that I was not out of status during the period November 2, 2008 - December 20-2008. Consulate will only ask for Blanket L1 I 797 and form I-129S which they are already preparing for my Visa extension.

I just need your expert advise to confirm if this information from employer is correct or not. Also, anything specific I must be aware of before going for Visa stamping. Thanks to all of you and keep doing the good work

You can always go to get a blanket petition visa stamped. What is the state of your L2s? Are they going with you as well?

As we are on the same boat , I mean we are also applying for the renewal of L1 ,L2
Can you please tell me what all the documents you presented/filled with your renewal applications for both the visa types..

Hi TxH1B,

I came to India on Dec-13 while my extension was still pending. I have taken appointment with USA consulate in New Delhi for 30th of December. On Dec-22 I checked status of my application online on USCIS website and it said that Extension application for I-129 and I-539 for my family has been approved. Does it imporves my chances of getting Visa. I don't have approval notice copy yet because it was mailed on Dec-22 and my attorney office is closed for holidays. I have downloaded and printed from USCIS for my reference.
Pease advise how to go further.

You need the approval doc and I797 for renewal.
