  • Regarding EAD

    Guys,

Currently I am on H1 visa.My wife has L1 visa and I am planning to move to L2 visa.
    My doubt is:

    1.Can I convert H1 to L2?
2.Can I work once I get my L1 or do i have to wait until I get my EAD?
3.How many days it will take to get my EAD?

    Regards

---- Yes, you can do a COS from H1 to L2

2.Can I work once I get my L1 or do i have to wait until I get my EAD?

---- Where does L1 come into picture

3.How many days it will take to get my EAD?

---- If it is EAD for L2 then it will take 3-4 months and you have to wait till you get L2 in hand to start working

          Hi

          Thanks for the repply.

I want to apply for EAD and then want to go back to India.
I am planning to come back to US once I get my EAD

Is it Possible? Can I do like that or is it mandatory that i should stay in US from the time I applied for EAD to until I gets it?

          Regards

The L2 EAD is granted based on your status which is determined by your I-94. Once you leave US, your I-94 record gets closed and USCIS cannot verify your status as you don't hold one once you are outside US.

You have to remain in US till the L2 EAD gets approved.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
