L1 extension denied -URGENT- Need Help Immediately

Hi,

I am working here in the US on L1B. My employer filed for my L1 extension in Oct 08 as my L1 expiry date was Nov 30, 2008. On Dec 16th, there was a RFE raised on my L1B extension and my employer responded to the RFE and the response was received at USCIS on 22 Jan 09.

The status in USCIS website was mentioned that my case has been resumed and they will let us know the decision 60 days from 22 Jan 09.

Yesterday (13 Mar 09) my employer told me that they received the decision letter from USCIS and my L1B extension has been rejected

Now my company is telling me to leave the country immediately I have a new born baby and I can't travel immediately as I have not yet got her passport and visa.

How many days can I stay in the US after receiving the decision letter on my Visa Extn?

And since my husband is on H1 here, Can he apply for my H4 immediately and can I stay legally here on H4 for sometime.

But my employer says, I can't apply for H4 now as I am already "Out of Status”. Is it true?

Will the rejection of my L1B extension affect me incase if my employer apply for any other visa in future?

I am planning to ask my employer to apply for L1A incase I am forced to go back to India in this coming week.

Can they apply immediately? Or is there any time frame that they have to wait to apply my L1 A?

Please advise me ASAP.

You cannot change your staus from within US at all as you are out of status. You should consider leaving immediately. Based on your situation, contact an immigration attorney to see if there is a way out to continue staying.

Once I am in India, can my employer apply for L1A. Do I need to wait for so many days before they apply L1A? If yes, how many days?

Please let me know how did u handle this situation? I am confused for filing my L1B extension because of a similar situation.
