    Hello,

    I'm in the US working on L1B visa. My I94 and the Visa is valid till Aug 27 2009
    The organization that I work for has asked me to submit the relevant documents by 05 May 2009 so that they can apply for extension.

    These days I've been hearing stories of L1 denials. In most of the cases USCIS is sending RFE even when the application that was submitted had clear details about the case.
    My questions are:

    1) If my L1 extension is rejected post Aug 27 2009, do I have to leave the US immediately ?

    2) If my L1 extension gets rejected by July 2009, can I stay in the US till Aug 27 2009 /

    3) If my L1 extension gets rejected by July 2009, can I reapply for L1 extension before Aug 27 2009 ?

    4) Suppose my L1 extension gets rejected and I've to leave the US, can I file a new L1 petition from my home country, get it stamped and come back?

    5) If (4) is yes, what are the chances of my new L1 petition getting denied ?

      Apply Premium Processing to have enough time to respond to RFE and also gives you time if extension is denied.

      >> They will specify by which date you should leave in the Denial Notice. Usually you have 30 days from the Denial.

      2) If my L1 extension gets rejected by July 2009, can I stay in the US till Aug 27 2009

      >> You can if the Denial Notice doesn't ask you to leave before your I 94 expiry.

      3) If my L1 extension gets rejected by July 2009, can I reapply for L1 extension before Aug 27 2009 ?
      Yes

      4) Suppose my L1 extension gets rejected and I've to leave the US, can I file a new L1 petition from my home country, get it stamped and come back?
      >>> Depends on how long you stayed in the US with current petition. You can try to get a visa from your home country on a new Blanket before your L1 and I 94 expire.

      5) If (4) is yes, what are the chances of my new L1 petition getting denied ?
