L1 visa expiring Dec 1st week. Round trip to India in Oct end. Issues?

    Hello,

    My L1 visa is expiring in Dec 1st week. I have applied with the extension docs to my office and they would be submitting to USCIS soon.

    1) I have to travel with my family to India in Oct & will be back by Nov., 14th. Is there any issue while travelling? I will be back around 3 weeks before my visa expires.

    2) What would happen if during my stay in India, USCIS rejects my visa extension OR ask for an RFE? In that case, would I be able to enter US since my visa is valid for another 3 weeks?

      Travel during an extension is never recommended. Discuss with your HR and company lawyers.

        thanks a lot for the replies to my question.

        1) I have applied for a premium processing. Once I get a verdict on whether USCIS is okay with the extension (assuming that happens by Oct end), can I go to India and come back by Nov 14th without having to stamp the visa. My visa is valid till 1st week of Dec.

        2) Does stamping have to happen only after the visa expires?

        3) Is there any freeze during the year end/Jan on stamping?
