  • L1 Extension-Wrong Service Center

    My L1 extension was filed on oct 15th. My current I-94 expired Oct 27th. Today I came to know that USCIS returned my petition back to my company as it was filed at a wrong service center.

    Company Attorney says they re-filed the case at the correct Service Center earlier this week and filed it as "nunc pro tunc" which means the case was filed after the date my visa expired but by no fault of mine. They say its standard and should have no negative implications....

    Any help would be appreciated...not sure what this means to my status?

    It is unpredictable as to what the result is going to be. USCIS may not accept the nun pro tunc and deny the extension which will render your stay illegal. Companies don't care about your status as YOU would have to suffer and not them.

    What was the need for them to wait till the 11th hour to file for an extension while it is allowed up to 6 months in advance.
