  • L1 Extension RFE

    Hi,

    Just wondering if there is some tread for RFE's again... Got RFE for L1 extension. Reason not yet know. Please let me know.

    - Usually how much time someone can stay in US after RFE is received.
    - Does RFE means that the case would be rejected? or there are chances that something was missing in the application and that would have called for a RFE.

    Your help would definitely be appreciated. Thanks in advance!

    >>> You can stay until a decision is been made (approval / denial of the petition). However, if the petition gets rejected, then the time that you have spent in U.S after your I-94 expiry will be considered as illegal stay.

    - Does RFE means that the case would be rejected? or there are chances that something was missing in the application and that would have called for a RFE.
    >>> RFE means "Request For Evidence". Meaning, USCIS wants more proof (Documents) or additional information to approve your petition. If provided within the given time frame, you are all good. Otherwise, the petition will get rejected.

      What happens in case of Illegal Stay?
      - I mean will that cause any problem next time I will apply for any VISA L1/H1....
      - The income I am earning will that be considered legitimate?

        Yes, you may face issues with future petitions and visa interviews. If you are illegal for more than 6 months, you could get up to 3 year ban. If you are illegal for more than 12 months, you could get up to 10 year ban.
