Applying L2 extension (I-539) concurrently with EAD (I-765)

  • Applying L2 extension (I-539) concurrently with EAD (I-765)

    Hi,
    I am going to apply for my L2 extension (I-539) via my husband's employer when they will apply for L1 extension request (I-129).

    I am also planning to apply for L2 EAD renewal (I-765) simultaneously with my I-539 form via my husband's employer.

    Hopefully employer will send the applications in a single package.

    My questions are:

    1) Could the EAD renewal process result in an RFE given the I-539 is not yet approved during the time of EAD application? Or, does USCIS automatically process EAD application based on approval of I-129 / I-539 at a later timepoint?

    2) My husband's employer is going to file L1 extension in premium mode. Will it mean L2 extension will also be automatically in premium mode?

    3) In terms of the document checklist for EAD application, should we include our prior L1 / L2 extension approval notices, I-797A ? Or, is it not required?

    Any insights would be greatly appreciated.

    USCIS will process all application together & it won't cause RFE on EAD at least. Ensure all application goes in single packet.

    Most probably yes. Since all applications will be in single packet, all will be responded at the same time.

    Better to provide that.

      Hi Pallavi,

      Our family is also in the same process. What all document you provided for EAD in concurrent filing?

      We are filing EAD along with I-29/I-539 and wondering documents required for evidence of approved petition.
