  • Question about EAD renewal

    Hi,

    Here are my details:

    L2 valid till July 2011
    I94 valid till July 2011
    EAD valid till Nov 2010

My question is, if I apply for my EAD renewal sometime in July 2010, will I get it renewed only till July 2011 which is my L2 expiration date or till Nov 2011?

Also, can we stay in the US is I94 is valid but blanket L1/L2 are expired?

    >>> EAD will be renewed only till your L2 validity (July 2011).

Also, can we stay in the US is I94 is valid but blanket L1/L2 are expired?
    >>> As long as the I-94 remains valid and you are in valid L1/L2 status, you can stay in the country.

      Hi,

      Thanks for the quick reply.

      I have one more question.

If we travel to India within this year, will we get a new I-94 at the port of entry or will it still remain with a validity that is same asour L1/L2 validity?

And if we do get a new I-94 that has a validity that supercedes the L1/L2 Visa validity, then will our stay in the US still depend on our L1/L2 expiration or the new I-94 expiration?

        >>> When you leave the country, you will have to return your current I-94. When you re-enter, you will get a new I-94. Depending on the officer, the new I-94 can be exactly upto the petition validity or it may have more validity than the petition.

And if we do get a new I-94 that has a validity that supercedes the L1/L2 Visa validity, then will our stay in the US still depend on our L1/L2 expiration or the new I-94 expiration?
        >>> Once you are inside the country, your I-94 decides your legal presence. You can stay until the I-94 validity.

          Hi,

Thanks again for the prompt reply.

          One (hopefully!) last question.

Suppose the immigraton officer gives us an I-94 that has a validity longer than our L1/L2, but my EAD was issued only till my L2 validity, can I apply for my EAD renewal based on my I-94's validity? Or is that still based on the L1/L2 validity?

Usually EAD will be issued only based on L1/L2 validity.
