  • L1A Individual Extension

    Hello Experts,

    My L1A Blanket is expiring on 04/05/2020. I have filed for an extension last month. Can somebody please tell me what the approval odds nowadays? and how much time does USCIS take to provide a decision (I know the processing times published by USCIS officially). I was interested in "actual" processing times as I understand there is still a difference between processing time published by USCIS and actual processing time.

    Now a days the extensions are taking minimum of 6+ months, i myself waiting since July 2019, regular processing, no RFE, not sure when i am going to get the decision and my i-94 expired on Sept 2019. Hope you may get the decision sooner.

      so I guess you will be hitting the 240 rule deadline soon...do you have to go back if you don't get the decision before 240th EOD?

        sai_1919 Yes, If you don't hear response from USCIS within 240 days, person (&dependents) should return to home country. But I heard in other forums that your petition may be still valid even left the country and if it is approved at later time, you can move back to US. I waited for 180 days and employer has started conversations asking to upgrade premium and I'm very much reluctant for it.

            No, if you do not hear from USCIS within 240 days, you can still stay in USA, but cannot work.

            Yes, the petition would be still valid & once approved, you can re-enter USA to continue your work.

            Its best to move the petition to premium in 180 days - to avoid any issues.

              sai_1919 Not to disappoint you, I heard the approval rate was very low last year, rock bottom last 2 quarters especially. I was told to be prepared for either situation.

                Not sure the 240 days rule is from the date of extension receipt date or the last approved petition expiration date. Can someone confirm?

                In any case i have a backup option GC EAD, so am not worried about the decision of the extension of petition.

                  What was your situation? when did you submit and how long you had to wait for the decision. Was it L1A? When did you receive L2 approval? I am trying to understand overall time I have in my hands.

                            Did you raise a service request when the case is outside processing time ? Which service center did you file in ?

                            I will reach case outside normal processing in some 5 days.

                            Does that SR Help ?

                              I think it's too early to raise an SR....it's been just a month...there is a long wait nowadays....
