  • L1B Extension pending, 240 limit approaching and selected in H1B FY21 lottery.

    Hello Forum Experts,

I am currently in situation where my L1B individual extension is still pending, I got RFE in March 2020 and RFE response was sent in this week.
I had PED date of initial 3 year visa till October 2019 and Individual Extension was filled before the PED date completion. This gave me 240 days of extension till June 2020.
Due to current ongoing situation I am unsure whether L1B individual extension approval status will come before June 2020. This puts in limbo situation where I cannot leave the country but at the same time I will be not employed to the current employer even though the L1B extension decision is pending after June 2020

My application was also picked in H1B FY21 lottery so due to that my employer immigration team suggesting not to leave the country, with the premium processing suspended the chances of application being worked till june are very slim considering no RFE in H1B application

Is there any possibility to get a Work authorization beyond 240 days considering the L1B application in pending state?
Is H1B lottery selection can give any advantage to increase the 240 days limit?

No, You can stay after 2240 days, but cannot work. No other possibility.

No, lottery doesn't give you anything. You can work only after your petition is approved & your status is changed to H1.
