  • Multinational General Manager (Asia) aspiring to move to US on L1A

    Hi friends,

    I need help to understand if I qualify under L1A category. Please read below:
    - I currently manage the India operations of a US based company for the last 3.5 years. There are more than 20 engineers across various functions reporting to me. I directly report to the founders of the company in USA. Our parent company in the US is more than 20 years old and has more than 100 employees.
    - In addition to managing the office in India, I also am responsible for business development in the SE Asia and Australia territory.
    - I started the India operations from scratch (with the only employee) and grew it to the current size. Before this too, my experience has been similar.
    - My company wishes to move me to USA. My potential role there would be to explore a new territory by doing market research, use my technical and business knowledge to find out if our product is suitable for variety of industry sectors in this territory, pass on suggestions to the R&D team to implement new features in the product to make it applicable for the new industry sectors, meet potential customers and make value propositions, sell our product to them, and finally grow the business with the customer and other customers. Potentially, there will be a new office in this territory, and a few engineers reporting to me. Until this office is opened, I will get support from engineers in our headquarters (in a different territory, but in USA).

    Do I qualify for L1A? Experts, please comment. If any lawyers have processed such cases, I will be happy to ask my company to consult you.

        Thanks Libra_14. My company has started the L1A application process. Here are few more questions based on the experience of Scooby_doo
        1) Do I need to share degree certificates of all employees reporting to me (approx 20) in my current role? How about in the proposed role
        2) Job description of all the people reporting to me?

        At this time, my lawyer has only asked for an org chart, and nothing more for the subordinates.

          Answers for both the question is same, it depends on your attorney - on how he prepares your petition. Some attorney add all those details in your application (degreed subordinates, JD etc) & some skip that. So go as your attorney is suggesting, might be he’ll ask for degree & JD once you share your Org Chart.

            My L1A petition was sent yesterday. This forum was very useful in preparing all the documents, and I eagerly await the decision. Thank you all, especially Libra_14. I will certainly keep everyone updated on this group.

              Hi all,
              Glad to update that my L1-A petition was approved in 10 days (with premium processing). This forum was very valuable indeed, and I could prepare a strong petition thanks to multiple experiences here. Now on to the next step -- visa interview.
