  • L1B rejection 3 months back, applying for B1

    I appeared for L1 B in July 2010 at Chennai consulate. It got denied under "Your blanket L-1 is not clearly approvable under section 8 CFR 214.2(I) (ii) (D) and INA 101(a)15(L)".

    My company is planning to process B1 for me, to attend a conference. I need to be there in US for one week only. So I will say the duration of stay as 1 week.

    Also, my husband is in US on F1 visa.

    I am worried if my visa will get rejected again. Is there any chance that my visa get rejected as a potential immigrant (because my husband is in US)?

    Will there be any impact by my previous visa rejection?

    ---- Yes, there are possiblities that your B1 visa will be denied as you say your husband is in the US on F1. Unless you strongly prove that you have ties back in India for you and your husband to return and the proof/evidence of such ties that convinces a VO that you will positively return back during the visa interview

    Will there be any impact by my previous visa rejection?

    ---- Previous rejection of any visa does not have any bearing on your present application for a visa in any class. Each visa application is independent and will be considered as a fresh application

      Thanks for your response. My employer is ready to process L1 individual for me in after 3 more months. So I am confused whether to go for B1 now or go for L1 individual later. Which one do you think as safer option in my case?
