Query for L1 and H1

  • Query for L1 and H1

    Friends, I am selected for H1B lottery and yet to file for petition using employer A. My current employer B wants to apply for L1B petition.

    1. Is it possible to file both L1 and H1B petitions in parallel using two different employer? Do we have any risk of rejection or questions being asked about one or another petition by counslate?

    2. If both L1 and H1 petitions are approved and I continue working with my current employer B using L1B. and later is it possible to transfer H1B to my current employer and change from L1 to H1 without working even single day for employer A.

    3. Please let me know if this is legal and valid case and if any risk ? or any other way to have this done safely ?

    Yes, one can apply & hold multiple non-immigrant petition/visa at any time (but not in parallel with immigrant visa).

    Having 2 petitions doesn't impact each other, but if you are not qualified it can be rejected. VO may ask question as why you have multiple petitions & you should be able to answer truthfully. Also, while giving you second (H1 or L1) visa, if he feels that the existing visa (L1 or H1) is of no use, he can cancel that.

    Yes, you can do that.

    My advise is to keep H1 petition safe with you (do not stamp H1), get L1 visa, fly to USA. H1 will stay valid for 3 to 6 years & you can change status from L1 to H1 with in that period. After that H1 is of no use.

      Thanks for the response. Is it possible to transfer my H1 to new employer even without activating the same ?
