  • H1B to L2-EAD

    Hi,

    I am currently in a H1B visa and my 6 years are expiring in December. My wife got a job and they are applying for a L1 visa. My question is - if I go on a L2 visa and get an EAD then will I be able to continue my employment on L2 EAD and get additional time or once the 6 years are over then I am out of luck and will not be able to work.

    Only the time spent in H1 or L1 status counts towards the 6 years. But you must spend 1 year outside the US to qualify for another 6 years of H1 time.

      so this means that if I go on L2 status then I can continue my current employment, beyond the 6 years that will be over in December?

        Yes, but if your spouse stops maintaining L1 status (leaves job, leave the US) your L2 status ends and you must leave the US too.
        Also, you must have approved EAD in order to work.
