  • L2 Visa queries- please help

    Hello,
I am a Canadian citizen and will be soon getting my L1A visa to move to the US. My plan is to apply for the L2 visa for my fiancé' (Indian citizen) after our marriage at the end of the yr. Would it make sense to rather perform a court marriage and apply for her L2 at the same time as I apply for my L1?
Can she apply for her L2 visa at Mumbai consulate office?

    Thanks!

You as a Canadian citizen don't need a visa. You would just show up to the US port of entry with your L1 petition approval to be admitted into L1 status. Your Indian citizen spouse needs a visa. The problem is that they cannot get an L2 visa unless you have an L1 visa or are already in L1 status. So you would enter the US first, and your spouse would use your L1 I-94 to get an L2 visa. If it would not be convenient for you to go the US first, then the consulate might have to issue you an L1 visa so your spouse can be issued an L2 visa.

This is my personal opinion and is not to be construed as legal advice.
