L2 Visa - I94 expiring soon - L1A extension approved for spouse

    Hi All,

    My spouse's L1A extension petition got approved recently. My L2S is expiring soon on 12/22/2022.
    I have applied for L2 extension today and not sure how long it is going to take. Questions that I have:

    1) If I travel outside of US and return back, will my I94 get updated based on my spouse's L1A extension approved petition or will the PoE office issue I94 only till my current stamped L2 visa?
    2) Alternatively, if I get a slot in the embassy to get my Visa stamped, how long will it take get my passport back from the embassy?

    1. Until your spouse's L1 I-94 expiration (you need to bring your spouse's L1 I-94)

      Thanks for the response! So if I carry my husbands I797 approval which has the I94 information with Dec 2024 date, would that still be accepted to extend my I94? The online I94 for my husband still shows 12/31/2022.

        It's not an "extension" -- an I-94 only applies to a particular stay, and ends when you leave the US. Rather, you are getting a new L2 admission on the basis of your L2 visa and your spouse's L1 status.

          Ensure you have a valid visa at the time of re-entry into USA along with recently approved L1 I797 - reference to point # 2 of your original post.
