L2S extension, working and i94

Hello all,

My wife will be filing for l2S extension soon. Her visa and i94 expires 31 December 2022. My question is can she work after 31 December while her extension has been sent into USCIS. I’m waiting for my L1 extension to come through, if it does we will leave and come back into the country to get an updated i94. Please advise if she can continue to work after 31 December.

No, she cannot work after I-94 expiration until the extension of stay is approved. Her leaving the US and re-entering will only work if 1) she has an unexpired L2 visa, and 2) your L1 extension of stay is already approved

Thanks for your response newacct we are hoping the l1 extension comes through asap so we can leave the country and come back in. Both our visas and i94 expire end December 2022. Application for l1 extension was received September 2 2022.

My souse I-797 got approved and my L2S extension also got approved. Am i eligible for working in US? Do i need to leave the country and come back for geting new I94?

Your L2 extension of stay approval should be an I-797A, which comes with a new I-94 as part of the page. You are authorized to work, and your L2S I-94 can be used as proof of work authorization for the I-9.
