  • L2 EAD application while on H1B

    Hi
I work as an engineer currently (first year of work in USA) on an H1B status. I just got married and my wife who is currently in India will be continuing her work in a USA office on an L1 visa sponsored by her company.
I want to change my job, and as a carrot to my prospctive employer I want to show that I dont need visa sponsorship.
    My questions:
    1) If my wife has L1 and I currently have H1B, is it ok to say that I can take an L2 with EAD to prospective employers?
    2) I guess the employer has to bare no fees for L2 with EAD.
    3) Can I apply for an L2 + EAD while I am still working for my current employer (with whom I work on an H1B) without telling them?
    4) What would be the appropriate time to resign and when would be the appropriate time to accept employment from a new employer?

I know this is a really long set of questions but your inputs would be really helpful.
    Thanks.

--- Yes, you can apply for L2 EAD, but you have to relinquish your H1B status once the L2 EAD is approved and you you take up employment on L@ EAd

    2) I guess the employer has to bare no fees for L2 with EAD.

---- that is asn issue between you and the employer

    3) Can I apply for an L2 + EAD while I am still working for my current employer (with whom I work on an H1B) without telling them?

---- Yes, you can certinly do taht, but the fact remains that you have to take up the employment on L2EAD adn give up your H1 status

    4) What would be the appropriate time to resign and when would be the appropriate time to accept employment from a new employer?

---- As soon as you get your L2 EAD you can resign and join the newe employer

----- You should consulat an atttoreny to have more and authentic information on all these matters so that you can make the best possible decsion
