  • I94 Expired, can one go to Mexico? **URGENT**

    My friend is on L1B visa valid up to Sep 2011. However, her I94 was valid only till yesterday (7-Feb-2011). She accidentally realized this. Her employer suggested to go to Mexico and come back immediately to get new I94.She is planning a travel for tomorrow.

    Is this the right solution as she is already overstaying?

    Can you please respond URGENTLY?

          To get I94 corrected

          In my case I'm still in status. I got I94 for a lesser duration because my passport validity. Now renewed passport. Can I go to Mexico and be back in a couple of days and get my I94 corrected to the date in my I797. I read that if you go to any of the neighbouring countries like Mexico, Cananda and Caribbean for less than 30 days you will NOT get new I94. Is that true? Can i get it corrected at a Deferred Inspection post. Pls advice on options . Thanks

            Yes, try the Deferred Inspection post first. It is true that if you travel to Canade / Mexico for less than 30 days, they will not take your I-94 when you leave. On your return they will ask you to use the same I-94. So you have to make sure that you return your I-94 without fail and get a new one on your return. If not, the entire trip will be for nothing.

              Thanks for responding Shervin. I'm in the bay area CA. Pls let me know where the nearest Deferred inspection post is located.
              Few days ago I called CPB office in SFO and I explained my case. The officer adviced me that no correction is required . All that I need to do was to take the I94 in my i797 and clip it next to the i94 given at POE. Many people are telling me that advice is not correct. What are your thots. Also is the Deferred inspection site different from CPB office
