  • I-94 extension RFE

    My I-94 has been expired in Jan '11 and L1B visa still valid till Dec'11.
    My employer has filed an I-94 extension before expiry date via premium processing.
    USCIS issued me a RFE. Company Attorney has advised me following options.

    1) Go back to India and once out from US company will withdraw petition.
    Once that done you can come back on a existing visa as it is still valid or
    apply for a new visa from India.

    2) Reply to your RFE's questions and if denial go back to India immidately.
    As per attorney if denial it will cancel all my visas B1, L1B. Also, can
    impact my chances to get any US visa in future.


    Is the option 1 will be ok? do you see any issue?

    Is any other option?

    Both are valid option.

    It has been best if you have left US before your I-94 expiry. Since extension is already in place, you can respond to RFE also which is again similar to going back India and re-enter.

      Thanks Rohit for your response.
      But as per attorney now a days majority of extension cases rejection are happening.
      Is petition withdrawal can affect my future travel to USA? As per attorney they will withdraw petition once I go back to India and this way my stay after I-94 expiry will not count as overstay.
      any thoughts?
