L1 B Extension Time Frame

Hello ,

My L1 B Visa expires in April 2011,but i still have a I94 until Oct-2011.

My Wife and my new born son are in India since Sep-2010 and my son was born in Dec-2010.

I am planning to bring my wife/son back here to the US on L2 VISA.

But since by L1B VISA is expiring in Apr-2011,they can not apply for L2 so quickly and travel.Also the kid is too small now to travel.

My Company is applying for my L1B extension from here and i have a few qustions on that..

1. When can they apply/file the extension.Is it only by May'2011 they can ? Since by I94 expires on 17-Oct-11.

2.How long does it take for the extension to be processed by uscis?

3.If my L1B gets extended,how soon can my wife/son file and get the L2 visa for them to travel? (Time to process L2)

4.L1 B extension is safer bet to apply or to goto India and file a fresh VISA is a better option?

My only advise is go for Premium Processing (requires $1225 extra) but you will get results soon as compared to normal processing. Extra $ either you need to pay if company is not ready to pay as they might not see any interest in quick results.

I know I'm not replying your all questions but thought of answering what I know.

Your employer should apply 6 month before your I-94 expire

2.How long does it take for the extension to be processed by uscis?
Normal 3-5 months. Apply in premium processing to get result in 1 month

Immediately

L1 Extension is bit more safer thesedays
