L2 giving birth to baby in US, will the baby be U.S. citizen?

  • L2 giving birth to baby in US, will the baby be U.S. citizen?

    I and my wife arrived to US 2 months ago. My wife's visa is L2, and she just has pregnancy for 1 month.

    So, if my baby is born in US, then will it be U.S. citizen?

        Search for fourteenth amendment to the US constitution.

        Any child born in the US is a US citizen irrespective of parent's immigration status (even if illegal).
        This is my opinion and not legal advice.

          I have another question:
          After my baby is born, and my baby has the birth certificate, and all the US citizen's process are done (I do not know what the process is yet), so what happens if I and my wife bring my baby back to my country?

          Does my baby still have the US nationality when my baby does not live in US for long time (may be more than 6 months) ?

            The baby will need to get a US passport and Visa to your home country.
            If the child lives in your country for all the while until he/she turns 18 and if your country gives citizenship based on parent's citizenship, then he/she will have a choice at 18 about which citizenship to choose.
