  • Urgent - L1 B Blanket rejected........

    Hi all,
    My company filed for L1 B Blanket in 2010 but it was not accepted at Chennai consulate. I got a blue sheet (221g) and it mentioned "Your blanket L-1 application is not clearly approvable under section 8CFR 214.2(I)(ii)(d) and INA 101(a)(15)(L)".

    VO told me to file either H1 B or L1 B individual. I filed L1 B individual and it got approved by USCIS. Now, I am filling DS-160 form and it has one question - "Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the point of entry?"

    What should I be writing here - Yes or No. If my first failed attempt for L1 B blanket was a refusal of visa?

    Pls advice as I will wait for response and then proceed to fill the form.

    Yes, it is a visa denial.

      My legal team member says that it is not a visa denial but consulate refused to adjudicate my L-1 blanket petition. I am very confused now as what I should fill in the DS-160 for "Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the point of entry?" - Yes or No.

      Any member who has faced similar problem pls provide some insight.

        Hi Pappu,

        As far as I know, I think it really doesn't matter because with in 2min of your interview VO won't see all that information, but they will ask that for records. Because one of my friends had the same experience and he put No when he is going for the stamping on L1B Individual. But again it may vary from case to case.

          Sorry mate, no clear answer to this. This is one of those many GREY areas. Suggestion would be to take advise from a reputable immigration attorney.

            221g is visa denial. No grey area. I know this from a very reputable lawyer.
