  • I94 extenstion for L2 Visa

    Me and my family (Wife and 6 years old son) came to US last month. I have L1 visa till May 2012. Me and my wife got I94 for another 3 years i.e. till Apr 2014. My son's passport is getting expired in Dec 2011 so immigration officer gave him I94 till Dec 2011. I understand that I have to apply for extension of my son's passport.

    How can I get the extension of my son's I94 after getting new passport? My nearest airport is Newark, NJ.

    Visit the Newark airport's CBP deferred inspection post. They may change the date.
    If that does not work, your son will have to file form I-539 to extend his status. Search for form and instructions on USCIS website. e-filing is available. This must be done before the current I-94 expires.
    As supporting documents attach, copies of your passport, I-94, petition approval notice, employment verification, paystubs and copies of son's I-94, new passport and birth certificate or other proof of your relationship. A cover letter will also help.

      Hi,

      I have the same case as your son. I checked the site and its saying that I-539 form is only for B1/B2. Can we apply for extension as we are on L1/L2 Visa?

      I am planning to go to Jamaica. If anyone has previously visited jamaica then do let me know if they issue new I94 or not.

        For H1, L1 employers need to file petition amendment to extend status (I-94).
        Traveling and returning is also another way of getting a new I-94 in passport renewal cases, any other country is okay. You must pass through CBP inspection while returning from any country and get an I-94 there.
