Hi All,
Iam currently on L1 and my wife is on L2 with EAD and working. Iam trying to get H1B filed for my wife this year. Below are some key concerns i have, any help will be appreciated.
1) I (L1 holder) will be leaving US in September and come back in a month, Can the L2 holder (with EAD) stay in US and continue working on EAD and switch to H1B starting October ?
2) Can we apply for L2 holder change of status to H1B before september once we receive the H1b approval notice?
3) When do you suggest will be the best time to apply for Change of status for L2 Holder when having a H1b approval in hand?
4) can the L2 Holder with Approved H1B stay in US during the month of September while L1 Holder outside of US?
