  • H1b extension premium or normal. Pl advise

    I am working on H1b. My I94 and visa expired in May end and my employer applied for extension a week before the I94 expired using normal processing. and its still in initial review stage

    My spouse is working on L1B and as a fallout plan, I wish to switch to L2 EAD in case my H1b is denied. I got to know that in case of a denial, I may not be able to switch my visa status and will have to leave US asap.

    Is that true that even after leaving USA, I would not be able to apply for L2 since I stayed illegally after my I94 expiry?

    Do you think I should switch to premium process to get the results earlier. Will that change any stand?

    >>> No. You are allowed to apply for the L2 visa. If approved, you can travel in L2. After entering U.S you can apply for EAD and when approved you can start working in L2 EAD.

    Do you think I should switch to premium process to get the results earlier. Will that change any stand?
    >>> It is not a bad idea to upgrade to premium and get the result in 15 days. If you have applied your extension 2-3 months before your I-94 expiry date, then you need not have to file in premium and spend money unnecessary
