  • L1 to L2 conversion

    I am on L1B and my visa got expired in June 2011. My company filed for an extension.
    I have also applied for L1 to L2 conversion and EAD as a dependent on my spouse for personal reasons.
    Now, the L1 extension is in RFE.
    Today I got the EAD card . I haven't received the L2 conversion approval notice yet. Dont know the status. USCIS site doesnt show the right status.
    Now I am still on my job with L1. Do I have to resign immediately ? How long can I stick to my current job with L1. ? Can I answer RFE and re-apply for L1 extn. ?
    Can some one please answer ?

    First your employer should respond to RFE.
    EAD gives you the right to work for any employer in any position as long as your spouse is in L1 status, most probably your change of status was also approved and you will get the notice soon.
    If L1 extension gets approved after change of status, your status will change again to L1. On L1 status you can only work for L1 petitioner.
    If you want to leave the L1 employer and join some other, ask your employer to withdraw the extension petition and then quit.

      I still have a question. I am talking to my current employer on next steps and waiting for their response. Do I have to quit immediately ?

        Your current status is L2 and you have EAD which allows you to work. Why would you quit? There is no need at all.
        But if you want to quit, you have the flexibility to do so right now. But if employer responds to the RFE and L1 gets approved with a new I-94, your status will again change back to L1 and then in that case you must maintain L1 status by working for your L1 employer.

          Thanks again,
          I have one more question. I got RFE a month ago. My employer asked me to answer the questions of RFE. How long can I / or my employer wait to respond the questions ?

            Your employer would have given you an end date - the RFE from USCIS has a respond by date

              EAD after applying for L2

              Hi,
              My husband and me are on L1 for the same company. Recently my company filed for change of status from L1 to L2 for me on my request. I got EAC number for L2 but, the L2 processing is not completed yet. Can I apply for EAD at this stage?

                You could have sent both the applications in the same envelope.
                Now send EAD application and attach copy of I-539 receipt notice.
