  • L1 extension for 2nd time

    Hi,

I recently came to US 1.5 months back after my L1 extension got approved and my visa is valid till 15th Sep, 2012 however I94 expiry date is 9th Sep, 2012. (FYI - My wife is also with me in L2).

Since I did not utilize full 5 years stay and only stayed in US for 1 year 9 months so far my questions are as follows:

    1. If I consider that I will be staying till my current I94 expiry then the total stay would be 2 years 8 months (1yr 9 mo + 11 mo). Am I eligable for further L1 extension next year?

    2. If answer of Q#1 is YES then, I would like to know what is the normal trend of L1 extension applying for 2nd time?

    3. If the rejection rate is high for 2nd time L1 extension, please suggest some option so that I can negotiate with my employer accordingly as to when exactly can I apply for H1 so that I don't have to go back to my country.

    Yes

    Max 6 months before I-94
    3. If the rejection rate is high for 2nd time L1 extension, please suggest some option so that I can negotiate with my employer accordingly as to when exactly can I apply for H1 so that I don't have to go back to my country.
See above. Replied about H1 in another thread.
This is my opinion and not legal advice.
