  • Consular Processing - H1B - INDIA

    Dear Immi Experts,

    Currently I am on L1B ,my wife is on L2 and our L1B extension is in process. At the same time my wife got some offer with one of the largest consulting company and her H1B is in process. But, due to some emergency she has to travel INDIA, her employer agreed to process it through Consular Processing if she has to go INDIA.

    Could you please let me know the following.

    1. How long it would take for the consular process from INDIA?
    2. What are the chances of approval since its going to be a fresh H1?
    3. What if she go to INDIA after she gets the H1B approval?

    Time it takes to get petition decision (2 to 3 months regular, 15 days premium with RFE, 1 to 2 months premium with RFE) + Time to get Visa (1 week without admin processing, unpredictable if admin processing needed)
    2. What are the chances of approval since its going to be a fresh H1?
    'Fresh H1' does not affect the chances. Consulting position makes it little tougher though.
    3. What if she go to INDIA after she gets the H1B approval?
    Does not matter. She will have to get H1 Visa anyway.

      Hi Kabkaba,

      Thanks for your response.

      Now she is decided to go ahead and requested her employer to process it through Consular Processing while sending the RFE, actually the RFE is very simple and they just need my 3 months pay slips.

      1.If my understanding is correct we may get the decision in 15 days, since they filed it under premium processing?
      2.Actually its not a consulting position, because she is going to work for one of the major USA MNC company, does it matter?

        Max 15 days after USCIS receives RFE response.
        Non-consulting position will work in her favor.
