RFE on employer details

  • RFE on employer details

    I've applied for L1 to H1 transfer through premium processing and got RFE asking for following documents.

    1. Education evaluation;

    2. Organizational chart;

    3. Copies of Company’s State quarterly wage reports for the last
    four quarters;

    4. Copies W2’s and W3 of the company;

    5. Copies of Company’s Federal tax returns for the years 2009
    and 2010 (include all schedules);

    6. Tax transcripts from IRS for the years 2009 and 2010;

    I'm more worried about the number & complexity of the documents required. My H1 employer has told it's a simple RFE and nothing to worry .
    Is it really a simple RFE or do I need to concern?

    If employer thinks this is simple and that they can provide all the documents easily, it should be okay.

      My concern is how far I can trust my employer.

      Is this a common RFE? or Very rare?

        This is a common one if your H1B employer is a consultancy company.If you cannot trust your employer then what is the point in filing a petition through them and workingf or them? Hope you did your research on the employer before accepting the offer.

          Can I leave the country when my status is RFE response Review? Will it be still considered as Change of status ? or consular processing?

            It is never advisable to leave the country when a petition is pending with USCIS. In your case, typically the petition if approved should be for consular process if you are out of the country. But in case it gets processed as a COS, then the approval notice will come with a new I-94 and you should return it back to CBP mentioning that you were out of U.S at that time. You are not suppose to have any I-94 when you are out of U.S.
