  • Moving from L1A to H1B

    Please advice !!!

I have another 3.5 months to completed 6 years in the US. I am currently on a L1A and I am planning to get a H1B and go for Green Card. What is the most suitable approach?

*** How long does it take to get the H1B done in quick time? May be through premium processing?

    1. Getting the H1B and requesting for Labor Certification soon will that be enough to get an extension to the H1B?
    2. Or do I have to get the 140 Approved in order to get the extension on H1B?

    3. Do I have time to get this done in 3.5 months?

    Thanks!!

It depends on exactly how much time you spent in the US in L1 status. It counts against the 6 year limit on H1 and in order to obtain extension beyond 6 years you need to have labor pending for 1 year or I-140 pending or I-140 approved. Discuss this with a good lawyer of your own.
This is my opinion and not legal advice.
