    Hi,

    I am in US on L1 visa and my visa will expire on 20-July-2012 but I have valid I-94 till Nov-2014.

    My wife is in India and her visa will also get expired on 20-July-2012.

    At present, my wife is expected and the delivery date of my baby is in starting April-2012.

    My Query is:
    Can I get the L2 visa for my new born baby in starting May-2012 keeping in mind that my L1 visa will expire on 20-July-2012?
    Please suggest and let me know if I can face any problem in getting L2 visa for my new baby.

    You can certainly get a Visa for the baby. It is possible that the Visa will expire in Jul 2012. But if the baby enters the US before Visa expiry, the I-94 can be obtained according to your I-94. Even if the I-94 is given according to Visa expiry, your dependents can file for extension using your I-94.
    If your baby is born in the US, he/she will be a US Citizen and no Visa will be needed.

      I have one more query, will it be any problem at port of entery, if my family travel 1.5 months before the L2 visa expire. Please suggest.

          Kid's visa scenario

          Hello,
          I am planning to apply for L1A visa for an assignment in USA. I am planning to process dependant visa (L2) for my wife and kid. My wife is a divorcee and the kid was born to her and her previous-husband. I need your advice on the following aspect.

          My wives's divorce happened 4 years ago and she has a court order (decree) states that she can take possession of the kid. But the court order also states that the previous husband can see the kid monthly once with prior notice.

          I would like to know if the kid's visa will be rejected because of the reason that the court order says that paternal father can see the child with prior notice.

          There is no contact between the kid and the paternal father for 7 years. Even then I thought I will take help from immihelp.
