L1-B extension query
Hi , I was in US on L1B blanket visa valid till 10-May 2011 from XYZ company. My company decided to file I-94 extn for me..so processed and sent petition to USCIS. After 5 months I received RFE.
but since my company was not assisting in responding to RFE, I decided to come back and file new Blanket Petition through XYX. So I returned back to India saying my personal emergencies to Indian immigration on 14 OCT 2011, and withdrawn my RFE petition. I recived notices from USCIS saying withdrwaing the petition.
Now I am held back as my company is not processing L1s since those are getting rejected and H1 cap is also over.
I had a doubt, in my case I stayed 5 more months after my I-94 expiry, waiting USCIS decision will that be a illegal stay in US?? Will it affect my new visa stamping if it happend in next 2-3 months??
