  • EAD status when L2 extension in process

    Hello,

    I filed my EAD renewal and received an RFE as that time my L2 visa was going to expire and had not filed for extension then.

    Now, my L2 visa extension is in process and I have I-539 that USCIS requested in response of RFE.

    My current EAD is going to expire on Dec 01, 2011.

    I am going to send response for EAD RFE on Nov 27, 2011.

    My question is can I continue to work on my current EAD when my visa extension is in process and I have submitted I-539?

    What would be USCIS's next step? Will they issue me temporary EAD/document?

    Hello,

    I am in a very similar situation and will tell you what I know.

    Your EAD will not be renewed until you have L2 extension in your hands. I have been waiting since August for my L2 renewal, my previous EAD expired then and USCIS will not process it until I can prove L2 current.

    I have been told by many sources that you cannot work without a valid current EAD card.

    I have called USCIS several times to try to plead with them to expedite my case but to no avail. They are just not concerned about people losing their jobs because they are so slow.

    I cannot renew my drivers license either

    The systems sucks really IMO

      You may be able to renew your DL based on the pending extension. Some states do that. Try contacting the state's main DMV office.
      The rest of the above seems correct.

        MariaC - when you asked them to expedite the process, they ask for reasons. Did you tell them that you are going to lose your job if you do not get EAD.

        I am renewing my EAD for third time and from my experience, the people on helpline are not aware of most of the clauses. I am sure you would have done your research, but when you talk to those people, ask them several questions about alternate ways. Sometimes, different people on helpline tells you different rules.

        I will keep you posted on my status.

          Well, firstly, the people on the phone "helpline" actually got rather annoyed with me for keep calling them. Told me I should be patient and I'll get it when I get it

          So I booked an Infopass appointment as I thought speaking with someone face to face might be better. Yes, I told them my job was in jeopardy and this is the answer I got........

          "Well, your husband is the primary visa holder so he should be able to keep you" !!!!!
