L1B to H1B Change of Status

Hi
I have a L1B Visa and I-94 which is due for expiry in Aug 2012.
My Same Employer is going to file for a H1B after cap opens this April.
So Can I stay and Work legally in US between my end of my current L1B Visa and start of my new H1B Visa which will start from oct 2012 in either of two scenario:
1.If I am still waiting for USCIS reply on my H1B Approval till my expiry of I-94 in August 2012
2.If my H1B gets approved before my expiry of I-94

Note that I am in US and planning to be with same employer throughout this process.

L1B to H1B Change of Status

Unless you file for L1 extension you cannot stay in US beyond Aug-2012. even if your H1 is approved you can only work on H1 only after 01-Oct-2012. You will be and illegally staying in US after Aug 2012 if you dont apply for L1 extension before your I-94 expiry. This is my opinion please do consult experts too.
