    Hi,

    I am in US on L1 visa since Dec'07. My first visa stamping was valid thru Oct 2010 and same for my wife. After that I was on I797 approval.

    Recently my wife travelled to India in Jan 2012. Feb'12 she attended visa interview for stamping they gave her 221g Yellow form with reason other “proof of husband is in status(Visa)”
    She was carring below documents:

    > I 94 (Visa Status of Husband) Clearly states I got admitted into US LEGALLY ON May 17th 2009
    > I 797 A (Visa approval of Husband) Valid until 10/31/2012
    > W2 (W2 year 2009 / 2010 / 2011)
    > Latest Paystub ( Month of Feb and Mar)
    > Interview/Appointment letter from VSA
    > Marriage Certificate
    > Passports New and Old of Spouse
    > Employment Verification letter

    Second time Mar'12 she submited all above paper and they gave her same 221g with reason asking “Copy of husband’s visa & legal status”.

    Has anyone been faced similar situation? What are they asking for husbands visa and legal status other than I 797 and I 94?

    I have wrote this to VFS Mumbai as well but no response yet. Please help as my son and my wife stuck and its my sons B'day soon.

    Copy of husband’s visa - Did you provide the copy of your passport, including visa page ?

      The doucments that you are enough to prove your legal status in U.S. While replying to the 221g, include more pay slips (sometimes 2 is not enough). if you work @ the client location, then try and get a client letter. Include the latest employment verification letter and copy of your current passport including the visa page (even if it is expired).

        I have stamping expired and valid I797. She submitted those documents with 3 years W2s and Employment Verification letter and salary slips I 94 as well.

        Do you think they are asking about valid stamping on my passport?

          No. You don't need to have a valid visa stamped in your passport for your wife to get her dependent visa. That is never a requirement. As long as you maintained your immigration status (valid petition and I-94 and proper pay slips and W2), she should get her visa stamped successfully.

            I have had all those document. Over the weekend I was able to speak to one the agent and got email address to send detail email. I sent all those documents to that email and got response that they will come back to me.

            I have sent passport with expired visa.
            valid I797
            I 94
            Employment verification
            All W2s
            Last 2-3 paystubs

            Waiting for their response.

              Alternative

              Hi Folks,

              Alternatively I have question how advisable it is to go to Canada for L1 stamping? This is 2nd approval and firstime approval was stamped from India and was valid until 2010.

              Just wanted to check if anybody has experienced any problem of stamping in Canada?

                Well, you can go to Canada. In case they want to do an admin processing, you might get stuck there for a while. So if you decied to go to Canada for stamping, be prepared in case your application goes into admin processing.
