  • L1B Transfer to H1B

    Hello

I am currently on an L1B visa (does not expire for another 2 years)
If i find a new job with a company willing to sponsor my H1b Visa, would I have to wait until October to start working there?
Is it difficult to trasnfer to a H1B visa?

    thanks
    Maria

Need more information. Are you planning to apply for the H1B for the first time or you already had a H1B approval within the last 6 years? What is your duration of stay in U.S in both L1 + H1B combined?

      Hello
this would be my first application for the H1b visa.
I entered the US on my L1B visa in July 2011.

      Thanks

Well, in that case, your H1B effective date cannot be prior to Oct 1st. You need to be working for the L1 employer to maintain your L1 status until H1B becomes effective (on or after Oct 1st). Once H1B COS becomes effective, you should be working for the H1B employer and any employment with the L1 employer after the H1B effective date is illegal.
